Power Perks Terms and Conditions

These Terms and Conditions apply to the Power Perks service as more particularly described below (the “Service”). References to “you” and “your” mean the EDF supply customer that has signed up to the Service. By participating in the Service, you agree to be bound by the following terms and conditions, together with any specific rules set out in any communications or documents relating to the Service (the “Terms and Conditions”):

The Service

  1. The Service will be facilitated by EDF Energy Customers Limited, a company incorporated in England and Wales with company number 02228297, whose registered address is at Nova North, 11 Bressenden Place, London, SW1E 5BY (“EDF”, “we”, “us”, and “our”). 
  2. To take part, you must sign up to the Service. The Service provides Eligible Customers the opportunity to receive free electricity during periods selected by EDF, such as when the wholesale electricity prices are negative or where EDF chooses to offer a free electricity event (a “Free Electricity Event”).
  3. These Terms and Conditions are separate and supplemental to any other terms and conditions that you may have with us now or in future. 

Eligibility

  1. To be eligible for the Service (“Eligible”), you must now and for the duration that you are signed up to the Service: 
    1. at all times comply with the Terms and Conditions;
    2. be aged 18 or over; 
    3. reside in England, Scotland or Wales; 
    4. be a current domestic electricity customer of EDF; 
    5. be signed up to and eligible for the Flextras product by EDF in accordance with the Flextras terms and conditions;
    6. be on a Time of Use Tariff as defined in Clause 5; 
    7. have a working electricity smart meter (meaning a meter that records information such as consumption of energy and can directly supply us with meter readings) that provides half-hourly meter readings;
    8. have consented, and not removed your consent, to giving us half-hourly meter reads
    9. have a valid mobile number registered to your EDF account; and 
    10. agree to be contacted by us via SMS, email, and notifications through the EDF mobile application in connection with the Service.
  2. The following tariffs constitute a time of use tariff (a “Time of Use Tariff”): 
    1. all import electric vehicle tariffs as offered by EDF from time to time; 
    2. all import heat pump tariffs as offered by EDF from time to time;
    3. all import solar or battery tariffs as offered by EDF from time to time; and
    4. any other tariffs that EDF may make available and eligible from time to time, excluding in each case any customer on a FreePhase Tariff.  
       
  3. EDF reserves the right to amend, replace, or withdraw any tariff that qualifies as a Time of Use Tariff under the Service.
  4. You agree to notify us if you are no longer Eligible for the Service. If, at any point, we reasonably suspect that you are no longer Eligible, we may remove or pause your participation in the Service.

Free Electricity Events

  1. Any Free Electricity Events are offered to you at EDF’s sole discretion. We do not guarantee any Free Electricity Event will be available or, if available, as to the duration for which it will remain available. EDF reserves the right at any time to amend, suspend, withdraw, cancel, or shorten any Free Electricity Event, including after notifying you of such Free Electricity Event.
  2. EDF may notify you by SMS, WhatsApp, email, or through the EDF mobile application in advance of a Free Electricity Event and its duration. 
  3. You do not need to opt-in to receive the free electricity from a Free Electricity Event. All electricity supplied by EDF to you during a Free Electricity Event will be free (“Free Electricity”). Any Free Electricity owed, or Free Electricity awarded as part of a Free Electricity Event, will be paid as a credit amount only, which shall be applied to your account. 

Meter Data and Bill Credits

  1. We will calculate any credits due to you under the Free Electricity Event by multiplying your total electricity consumption during the Free Electricity Event by the relevant unit rate applicable to your electricity tariff at the time of the Free Electricity Event. 
  2. We are under no obligation to apply any credit to your account if your meter reads are unavailable, delayed, or incomplete during a Free Electricity Event. 
  3. Any credits calculated in accordance with Clause 11 will be credited to your EDF energy account in the first week of the calendar month following the month in which the relevant Free Electricity Event occurred. Any credits are inclusive of VAT (if applicable).
  4. Any credits cannot be redeemed, traded or received in any other format than a credit into your EDF energy account and cannot be transferred to any other person or supply account.
  5. If we make any overpayment or underpayment to you, we may adjust future credits to reflect this or require reimbursement of any overpayment.

General

  1. EDF reserves the right to suspend, extend, revoke, amend or replace all or part of the Service and these Terms and Conditions, including but not limited to where it must comply with the decision of any relevant judicial or regulatory body, with immediate effect, and shall not be held liable for doing so. The latest version of these Terms and Conditions will be available on EDF’s website and on the EDF mobile application.
  2. By signing up to the Service, you warrant that all information submitted by you is true, current and complete. If any information you provide is found to be fraudulent or incorrect or if EDF has reasonable grounds to believe that you have breached any of these Terms and Conditions, you will automatically no longer be Eligible and EDF may suspend or withdraw your access to the Service and reclaim from you any sums paid or credited under any Free Electricity Event and this Service. 
  3. To the fullest extent permitted by applicable law, EDF shall not be liable to you for any loss, damage, cost or expense you incur whatsoever and howsoever caused arising out of or in connection with your use of, or inability to use the Service, including but not limited to any losses which arise from any technological failures, network interruptions, system outages, infrastructure issues, software defects, cybersecurity incidents, data transmission errors, or any procedural omission, action, inaction or delay or decision by EDF and any other third parties (including but not limited to EDF’s third party partners) or event or processes beyond EDF’s direct control or which EDF may rely upon in order to facilitate the operation of the Service and the delivery of any Free Electricity Events to you. Nothing in these Terms and Conditions is intended to exclude any liability for death or personal injury as a result of EDF’s negligence or generally for intent as well as for gross negligence.
  4. Each of these terms shall be a separate provision applying and surviving even if for any reason one or other of the said provision is held inapplicable or unreasonable in any circumstances.
  5. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions or their subject matter or formation. 
  6. EDF does not intend that any part of these Terms and Conditions shall be enforceable solely by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to these Terms and Conditions.
