Flextras Loyalty Programme Terms and Conditions

These terms and conditions apply to the Flextras rewards and loyalty programme as more particularly described below ("Flextras"). References to “you” and “your” mean the EDF electricity and/or gas supply customer that has signed up to Flextras. By signing up to Flextras, you agree to be bound by the following terms and conditions (the “Terms and Conditions”):

Flextras

  1. Flextras is provided and facilitated by EDF Energy Customers Limited, a company incorporated in England and Wales with company number 02228297, whose registered address is at Nova North, 11 Bressenden Place, London, SW1E 5BY (“EDF”, “we”, “us”, and “our”). 
     
  2. Subject to Clause 3, Flextras is available through the EDF mobile application that you may have access to.
     
  3. Flextras offers Eligible customers access to rewards, benefits, offers, and promotional schemes that we may make available from time to time, including third party offers and discounts and certain onboarding rewards available upon successful sign up to Flextras (each a “Benefit”, collectively the “Benefits”). Details of the Benefit(s) relating to onboarding rewards are set out in Annex 1 (Onboarding Rewards).
     
  4. The Benefits available under Flextras may change from time to time and may be subject to availability. Benefits under Flextras are provided to you at our sole discretion, and we do not guarantee that any particular Benefit will be available at any given time. 
     
  5. Being Eligible to participate in Flextras does not guarantee that you will receive or be able to take part in any or all Benefits. This is because the Benefits may be subject to separate eligibility criteria that you must meet, and separate terms and conditions that you will be bound to. Being eligible for one Benefit does not automatically guarantee eligibility for another Benefit. 
     
  6. These Terms and Conditions are separate and supplemental to any other terms and conditions that you may have with us now or in future, including those that govern the Benefits, and any terms and conditions that you may be required to agree with our third party partners. 

Eligibility 

  1. To be eligible to access and participate in Flextras (“Eligible”), you must now and for the duration that you are signed up to Flextras:
    1. at all times comply with these Terms and Conditions; 
    2. be aged 18 or over; 
    3. reside in England, Scotland or Wales; 
    4. be a current domestic electricity and/or gas customer of EDF; 
    5. have a valid email address registered to your EDF account; and
    6. have downloaded, signed up, and have access to the EDF mobile application.
       
  2. You agree to notify us if you are no longer Eligible. 
     
  3. We may suspend or remove your participation in Flextras for any reason and at any time, including where we reasonably suspect that you are no longer Eligible. 

Third Parties, Personal Data, and Marketing Preferences

  1. In certain circumstances, we may transfer your personal data to selected third parties because we have a legitimate interest in being able to provide you with full access to Flextras and the Benefits. We respect your privacy and are committed to providing you with a clear understanding of how we use your data.   2. You may update your communication and marketing preferences at any time by following the opt-out instructions included in our marketing communications sent to you. However, if you choose to opt out of certain or all communications, you accept that you may be unable to receive or redeem all or part of the Benefits which rely on us being able to communicate with you. 

General

  1. Any Benefit available cannot be redeemed, traded or received in any other format than what is advertised and cannot be transferred to any other person or supply account.
     
  2. EDF reserves the right to end, extend, revoke, amend or replace all or part of Flextras, the Benefit, and these Terms and Conditions, including but not limited to where it must comply with the decision of any relevant judicial or regulatory body, with immediate effect and shall not be held liable for doing so. The latest version of these Terms and Conditions will be available on EDF’s website and the EDF mobile application.
     
  3. By signing up to Flextras or, where applicable, selecting to participate in any Benefit offered through Flextras, including redeeming any onboarding rewards (as described in Annex 1), you warrant that all information submitted by you is true, current and complete. If any information you provide is found to be fraudulent or incorrect or if EDF have reasonable grounds to believe that you have breached any of these Terms and Conditions, you will automatically no longer be Eligible, and EDF may suspend or withdraw your access to Flextras and the Benefits and reclaim from you any sums paid under any Benefit, including under any other agreement you have with EDF. 
     
  4. To the fullest extent permitted by applicable law, EDF shall not be liable to you for any loss, damage, cost, or expense you incur whatsoever and howsoever caused arising out of or in connection with your use of, or inability to use, Flextras, including but not limited to any losses which arise from any technological failures, network interruptions, system outages, infrastructure issues, software defects, cybersecurity incidents, data transmission errors, procedural omissions, actions, inactions or delays or decisions by EDF and any other third parties (including but not limited to EDF’s third party partners) or event or processes beyond EDF’s direct control or which EDF may rely upon in order to facilitate the operation of Flextras and the delivery of any Benefits to you. Nothing here is intended to exclude any liability for death or personal injury as a result of EDF’s negligence or generally for intent as well as for gross negligence.
     
  5. Without prejudice to the foregoing, the maximum liability of EDF to you arising under these Terms and Conditions for any and all claims shall not exceed the maximum sum of £250 (two hundred and fifty pounds sterling) in the aggregate.
     
  6. Each of EDF’s third party partners may have varying terms and conditions including refund policies which need to be reviewed carefully before confirming as these are beyond EDF’s direct control. 
     
  7. Each of these terms shall be a separate provision applying and surviving even if for any reason one or other of the said provision is held inapplicable or unreasonable in any circumstances.
     
  8. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions or its subject matter or formation. 
     
  9. EDF does not intend that any part of these Terms and Conditions shall be enforceable solely by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to these Terms and Conditions.

Annex 1: Onboarding Rewards (Benefits)

  1. Eligible customers who join Flextras may receive the following onboarding rewards upon successful sign up (the “Onboarding Rewards”):
    1. a 12-month Tastecard membership (the “Tastecard Membership”); and 
    2. four (4) free hours of electricity (the “Onboarding Free Hours”). 
       
  2. These Onboarding Rewards are at all times subject to the provisions of and your compliance with the Terms and Conditions. Signing up to Flextras does not guarantee that you will receive or be entitled to any of the Benefits, including these Onboarding Rewards.

The Tastecard Membership

  1. The Tastecard Membership is part of the Benefits and is facilitated by Ello Group Limited (“Ello”), a company registered in England and Wales with company number 09578541, having its registered address at Birkby Grange, 85 Birkby Hall Road, Birkby, Huddersfield, England, HD2 2XB.
     
  2. To enable us to provide you with full access to the Tastecard Membership, and in accordance with Clause 10 of the Terms and Conditions, we may share your personal data with Ello when you sign up to Flextras because we have a legitimate interest in allowing Ello to provide you with information on how to redeem the Tastecard Membership as part of the Benefits that are available to you in Flextras. 
     
  3. By participating in Flextras, you understand and accept that Ello’s privacy policy will apply to the processing of your personal information for the purposes of providing you with access to the Tastecard Membership, including sending marketing communications.   4. You may opt-out of receiving marketing communications from Ello at any time by clicking the unsubscribe link included in their emails or by following any other opt-out instructions contained in their communications to you. 

The Onboarding Free Hours

  1. Subject to your continued Eligibility, the Onboarding Free Hours will be awarded as follows: 
    1. if, when you successfully join Flextras, you have a working electricity smart meter (“Smart Meter”) (meaning a meter, which in EDF’s sole opinion, records accurate and complete information such as consumption of energy and can successfully supply us with meter readings when required to) that provides half-hourly meter readings, the Onboarding Free Hours will automatically be added to and displayed in your account on the EDF mobile application;
    2. if, when you join Flextras, in EDF’s sole opinion you have a faulty, damaged or improperly performing Smart Meter, or a Smart Meter that does not provide half-hourly meter readings, you may be prompted to switch to a Smart Meter that provides half-hourly meter readings. Once EDF confirms that your Smart Meter is able to provide and is providing half-hourly meter readings correctly, the Onboarding Free Hours will automatically be added to and displayed in your EDF mobile application;
    3. if, when you join Flextras, you do not have a Smart Meter, you may be prompted to arrange for a Smart Meter installation. Once EDF confirms the Smart Meter has been successfully installed at your premises and is correctly providing half-hourly meter readings, and provided that you have agreed at all times for your Smart Meter to provide EDF with half-hourly meter readings, the Onboarding Free Hours will automatically be added to and displayed in your EDF mobile application. 
       
  2. Once the Onboarding Free Hours have been added to your account on the EDF mobile application, you may choose when to use them, provided that if you join Flextras in September 2026, the Onboarding Free Hours may only be available to be used from October 2026 onwards. 
     
  3. The Onboarding Free Hours will expire 12 months after the date that they were added to your account on the EDF mobile application (the “Free Hours Expiry Date”). Any unused Onboarding Free Hours will be forfeited immediately upon the Free Hours Expiry Date, and EDF shall have no liability to you in respect of such forfeiture.
