Sunday Saver Terms and Conditions

These terms and conditions apply to the Sunday Saver service as more particularly described below (the “Service”). References to “you” and “your” mean the EDF customer that has opted-in to the Service. By participating in the Service, you agree to be bound by the following terms and conditions, together with any specific rules set out in any communications or documents relating to the Service (the “Terms and Conditions”):

The Service
1. The Service will be facilitated by EDF Energy Customers Limited, a company incorporated in England and Wales with company number 02228297, whose registered address is at Nova North, 11 Bressenden Place, London, SW1E 5BY (“EDF”, “we”, “us”, and “our”). 

2. The Service will start on the first Monday of each month and end on the Sunday following the last Monday of each month (the “Service Period”). We may choose to cancel and/or amend the Service at any time during the Service Period and will notify you if we choose to do so. 

3. To take part, you must opt-in to the Service. By participating in the Service, you agree to be bound by these Terms and Conditions. 

4. These Terms and Conditions are separate to the terms and conditions you have for the supply of your electricity and/or gas. Participating in the Service will not affect the existing rights and obligations under those terms. 

Eligibility 
5. To be eligible for the Service (“Eligible”), you must, for the duration of the Service Period: 
• at all times comply with the Terms and Conditions; 
• be aged 18 or over; • reside in England, Scotland or Wales; 
• be a current domestic electricity customer of EDF; 
• have a working electricity smart meter (meaning a meter that records information such as consumption of energy and can directly supply us with meter readings) that provides half-hourly meter readings; 
• have a working electricity smart meter that provides at least 90% of half-hourly meter reads for the period where we calculate your Baseline (as defined in Clause 10); 
• have consented, and not removed your consent, to giving us half-hourly meter reads; 
• have exactly one electricity import meter point administration number; 
• be on an electricity tariff that has no more than two unit rates; 
• have a valid mobile number on your account; 

6. You agree to notify us if you are no longer Eligible for the Service. If, at any point throughout the Service Period, you are no longer Eligible or you move house, we may remove you from the Service. 

Service and Participation
7. During the Service Period, each week you will be offered an incentive (as set out at Clause 11) to reduce the proportion of electricity that you consume between 4pm - 7pm, Monday through Friday (the “Peak Period”).
 
8. At the beginning of the Service Period, we will tell you how much you need to reduce the proportion of electricity consumed in the Peak Period compared to your Baseline in order to qualify for the incentive (a “Challenge”).

9. We may also invite you to take part in one-off free electricity events (an “Event”). EDF Sunday Saver Terms and Conditions. 


Baseline
10. In order to determine if you have reduced the proportion of electricity consumed in the Peak Period as part of the Challenge, we will calculate your baseline consumption (the “Baseline”). The Baseline will be calculated by taking a weekly average of the proportion of electricity you consumed in the Peak Periods during each week that started in the calendar month prior to the commencement of the first Service Period that you participate in. We will adjust the Baseline for weather corrections, and we reserve the right to apply any other corrections. The Baseline, as adjusted by us from time to time, will apply for future consecutive Service Periods that you participate in. We will recalculate your Baseline if your participation in the Service ends or pauses (for example you do not sign-up to participate in a future Service Period, you move house or you are no longer Eligible), the Service is ended or paused by us, or we determine there is an error in the Baseline calculation. The day(s) where an Event has taken place (if any) will be excluded when calculating your Baseline. 

Incentive 
11. If we determine that: 
(a) you have successfully participated in the Challenge; and (b) remain Eligible, you will receive free electricity awarded by way of a credit to your account in accordance with Clauses 14 and 15 (“Free Electricity”). This Free Electricity will be available during specified periods on Sundays and we will communicate these periods to you. The amount of Free Electricity you receive will vary depending on the Challenge and how much you reduce the proportion of electricity you consume during the Peak Period compared to the Baseline (see Clause 12 below). We will communicate the number of hours of Free Electricity you have achieved each week. 

12. The below table sets out the percentage reduction to your Baseline usage during the Peak Period that you would have to achieve to earn Free Electricity hours.

13. Free Electricity awarded as part of the Challenge or free electricity awarded as part of an Event will be calculated by multiplying your total electricity consumption in the allocated Free Electricity period by the unit rate of the electricity product you have a contract for. 

14. Any Free Electricity owed, or free electricity awarded as part of an Event, will be paid as a credit amount only (“Payment”), which shall be applied to your account. If we make any overpayment or underpayment to you, we may adjust future Payments to reflect this or require reimbursement of any overpayment. Any notified Payments are inclusive of VAT. Payments cannot be withdrawn by you as cash or cash equivalent. 

15. We are under no obligation to make any Payment to you if we are unable to obtain your meter reads to calculate your electricity usage during the Challenge, Free Electricity periods or an Event. However, if we are unable to obtain at least 90% of your half-hourly meter reads during the Challenge we will provide you with a Payment of a credit amount only of the average amount earned by participants who earned Free Electricity in that week. If we are unable to obtain at least 90% of your half-hourly meter reads during the Free Electricity period or an Event, we will provide you with a Payment of a credit amount only of the average amount earned by participants who earned or were awarded the same number of free hours as you. 

Use of Your Information and Communication from us
16. To deliver the Service, we may share your information, including personal data, with our partners, including the relevant electricity network operators (such as Distribution Network Operators and the National Electricity System Operator). Your information collected and shared with our partners may include half-hourly meter readings and other consumption data, Meter Point Administration Number (MPAN), name, address, and contact details as necessary. By participating in the Service, you agree to: 
(a) have your information collected and shared with our partners for the purposes of delivering the Service; and (b) us entering your Meter Point Administration Number (MPAN) into services with the relevant electricity network operators (such as Distribution Network Operators and the National Electricity System Operator). 
Our privacy policy shall apply to any data collected and shared in connection with the Service, which can be found in our policy

17. By participating in the Service, you agree to receive communication from us via email, SMS, and WhatsApp for service-related purposes, including for the purpose of inviting you to the next Challenge. 

General 
18. By participating in the Service, you warrant that all information submitted is true, current, and complete. If any information is found to be fraudulent or incorrectly completed or if we have reasonable grounds to believe that you are in breach of these Terms and Conditions or are no longer Eligible, we may remove you from the Service and reclaim any payments made under the Service. 

19. We are not liable to you for any loss that is incurred under the Service or by participation in a Challenge, including but not limited to any losses which arise from any technological or procedural omission, failures, or errors and/or any action or inaction by us or any third parties or event beyond direct control on which we may rely upon in order to provide the Service to you. 

20. In our sole discretion, we reserve the right to reject or revoke your participation in a Challenge, withdraw from or pause the Service, and/or amend the Terms and Conditions without prior notice during the Service Period. Any decision taken by us under Clause 20 shall be effective immediately. We shall notify you if amendments are made to these Terms and Conditions during the Service Period. We reserve the right to change the Terms and Conditions in compliance with judicial or regulatory rulings and will not be held liable. 

21. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
