Terms & Conditions for EDF’s “Beat the Peak+” Trial

These Terms and Conditions apply to the Beat the Peak+ Trial (the “Trial”). By participating in the Trial, the Customer agrees to be bound by the following Terms and Conditions:

The Trial

1. The Trial will be facilitated by EDF Energy Customers Limited, a company incorporated in England and Wales with company number 02228297, registered at 90 Whitfield Street, London, W1T 4EZ (“EDF”).

2. The Trial period will start at 00:01 on Monday, 1 April 2024, and end at 23:59 on 30 March 2025 (the “Trial Period”). EDF may choose to end the Trial at any time before 30 March 2025 or to extend it beyond 30 March 2025 and will notify the Customer if they do so.

3. To take part, the Customer must register their interest in the Trial. By participating in this Trial, the Customer agrees to be bound by these Terms and Conditions (“the Customer”).

4. These Terms and Conditions are separate from the terms and conditions for the supply of electricity that the Customer has with EDF and will not affect the existing rights and obligations under those terms.


5. To be eligible for the Trial (“Eligible”), the Customer must, for the duration of the Trial:

at all times, comply with these Terms & Conditions;

  • be aged 18 or over
  • reside in Great Britain (excluding Northern Ireland)
  • be a current domestic electricity customer of EDF
  • have a working smart meter for their electricity supply from which EDF can obtain half-hourly readings
  • not be and not reside with a person(s) who is medically vulnerable and/or dependent on the supply of electricity to the property for any medical reason
  • consent to give EDF half-hourly reads
  • be on single-rate (STD) tariff; and
  • have a mobile number connected to their account

6. The Customer agrees to notify EDF if they are no longer Eligible for the Trial. If, at any point throughout the Trial, the Customer is no longer Eligible or they move house, EDF reserves the right to remove the Customer from the Trial.

Trial and Participation

7. EDF will contact Eligible Customers before the Trial to confirm their participation.

8. Each week in which a Challenge (as defined in Clause 9) is running, the Customer will be asked to reduce the proportion of electricity they consume during the peak, Monday through Friday. The peak will be notified to the Customer and may vary, but it will typically be between 16:00 and 21:00 and last for three consecutive hours each weekday (“Peak Period”).

9. At the start of each month, EDF will tell the Customer how much they will be asked to reduce the proportion of electricity that they consume in the Peak Period for each week that commences within the calendar month (“the Challenge”). EDF may elect not to run the Challenge every month, meaning no Challenge will be set, and the Customer will not be asked to reduce the proportion of electricity they consume in the Peak Period.

10. EDF is under no obligation to invite the Customer to take part in the Challenge. There is no guarantee or minimum length of time the Challenge will run. The Customer acknowledges that participation in the Trial is voluntary, and no payment will be offered or made to any Customer by EDF for participation in the Trial or any Challenge.


11. EDF must calculate a baseline for EDF to determine if the Customer has reduced the proportion of electricity consumed in the Peak Period as part of the Challenge. The baseline for any Challenge will be calculated by taking a weekly average of the proportion of electricity the Customer has consumed in the Peak Period from weeks that commence within the previous calendar month (whether or not a Challenge also took place during the previous month) (“Baseline”). EDF will apply a weather correction to the Baseline and reserves the right to apply any other corrections.

12. If EDF is unable to obtain at least 90% of the Customers’ meter reads when calculating the Baseline, the Customer will not be Eligible to take part in the Challenge.

Data Protection and Publicity

13. As part of the Trial, EDF may share Customer information, including personal data, with partners, including Loughborough University, The University of Sheffield, the Department for Energy Security and Net Zero and EDF Energy R&D UK Centre Limited (“Partners”), including for research purposes. The Customer information collected and shared with EDF’s Partners may include half-hourly reads and other consumption data, Meter Point Administration Number (MPAN), name, address and contact details. By participating in the Trial, the Customer agrees to have their information collected and shared with EDF’s Partners. EDF’s privacy policy shall apply to any data collected in connection with the Trial, which can be found in our Privacy and Cookie Policy section.

14. By participating in the Trial, the Customer agrees to receive communication from EDF and its Partners via email, SMS, and WhatsApp for trial-related purposes.


15. By participating in the Trial, the Customer warrants that all information submitted by them is true, current, and complete. If any information is found to be fraudulent or incorrectly completed or if EDF has reasonable grounds to believe that the Customer is in breach of these Terms and Conditions or is no longer Eligible, EDF reserves the right to remove the Customer from the Trial.

16. EDF is not liable to the Customer for any loss that is incurred under the Trial or by participation in the Challenge, including but not limited to any losses which arise from any technological or procedural omission, failures, or errors and/or any action or inaction by EDF or any Partners or third parties or event beyond direct control on which EDF may rely upon in order to provide the Trial to the Customer.

17. EDF, in its sole discretion, reserves the right to reject or revoke the Customer’s participation in the Challenge or Trial, to withdraw from or pause the Trial and/or to amend the Terms and Conditions without prior notice at any point during the Trial Period. Any decision taken by EDF under Clause 17 shall be effective immediately. EDF shall notify the Customer if amendments are made to these Terms and Conditions. EDF, in its sole discretion, reserves the right to withdraw or vary these Terms or Conditions to comply with the decision of any relevant judicial or regulatory body and shall not be held liable for doing so.

18. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
