Terms and Conditions
These terms and conditions comprise the agreement (the “Agreement”) between you (“You”) and EDF Energy relating to the provision of equipment and electricity for use with Your electric vehicle (the “Eco:Recharge Package”). The Eco:Recharge Package includes a site survey, the installation of a home charge point and EV smart meter (together the “Equipment”) and an electric vehicle statement which are supplied and where appropriate installed on the terms and subject to the conditions of this Agreement and Your energy supply contract a copy of which will be provided to you. This Agreement shall be binding on You in accordance with its terms.
- EDF Energy obligations to you
- EDF Energy will contact you following receipt of the pre site questionnaire (the “Questionnaire”) completed by You to arrange a site visit at a mutually convenient time within the hours of 9am to 5pm on a Working Day.
- EDF Energy will advise You of the locations at which it is appropriate to install the Equipment, and install it in an appropriate location. EDF Energy will try to agree a suitable location with You, provided always that the Equipment shall be installed in a location EDF Energy assess as safe and appropriate for the operation of the Equipment.
- EDF Energy shall install the Equipment in accordance with the earthing standards current at the time of installation. If You subsequently upgrade the earthing in Your home or premises (the “Premises”), Your instructed installer will need to ensure that there is sufficient earthing for the Equipment. EDF Energy accepts no responsibility or liability in connection with such circumstances.
- Where the installation of the Equipment by EDF Energy causes structural damage to Your Premises, EDF Energy will make all reasonable repairs but shall not be required to restore the Premises to its previous condition (including painting and redecoration) which remains Your sole responsibility and EDF Energy assumes no liability whatsoever in this respect.
- EDF Energy will send all notices to You in relation to Your Eco:Recharge Package to the address provided by in Your Questionnaire. If You wish these notices to be sent to another address please write to EDF Energy at the address at the bottom of these terms and provide details of the same.
- EDF Energy will use data from the EV smart meter installation to calculate Your cost and carbon saved on using an electric vehicle compared to an internal combustion engine vehicle for the purposes of internal administration, marketing and advertising. Your acceptance of the Eco:Recharge Package on these terms and conditions shall be deemed by EDF Energy to constitute Your consent for EDF Energy to use such data for these purposes.
- EDF Energy will not be responsible for the repair or maintenance of any wiring, fuse board consumer unit or any other ancillary or other equipment not installed by EDF Energy.
- EDF Energy has no obligation to remove any part of the Equipment from the Premises should You move or in any other circumstances. The Equipment is non transferable to another property or location within the Premises and any warranty contained in this Agreement shall automatically lapse where the Equipment is moved. EDF Energy may agree to move the Equipment for You for an appropriate fee which will be assessed in Your specific circumstances. - EDF Energy shall not be responsible for any loss, damage or claim as a result of radiated emissions from any electric vehicle owned or used by a Customer or any third party.
- EDF Energy will not be liable to You for any indirect or consequential loss whatsoever, for any event or circumstance beyond its reasonable control nor for any loss or damage that was not reasonably foreseeable at the time that this Agreement was entered into (other than as a result of fraud or fraudulent misrepresentation committed by EDF Energy). All obligations, warranties, and conditions implied by law or otherwise and any liabilities that arise from them are excluded so far as is permitted by law.
- EDF Energy’s liability to You under this Agreement shall be limited to up to £1,500 for any one incident, subject to an aggregated maximum of £7,500 in respect of all incidents for which EDF Energy is liable in relation to this Agreement.
- Your obligations to EDF Energy
- You agree to provide EDF Energy with at least 48 hours notice if you have to cancel your appointment(s). Failure to do so will result in the loss of your booking fee of £50.
- Where You are not an energy customer of EDF Energy, You must change Your electricity supply to EDF Energy. You acknowledge and agree that as part of the Eco:Recharge Package, You will transfer to EDF Energy’s Eco:20;20 tariff which allows You to take advantage of 20% off charging at evenings between 9pm and 7am GMT and weekends.
- Should You choose to change Your electricity supplier from EDF Energy while benefiting from Your Eco:Recharge Package You acknowledge and agree that EDF Energy will be unable to provide You with an electric vehicle statement and in such circumstances You waive Your entitlement to receive such statement and other benefits that can not longer be reasonably supplied by EDF Energy.
- You warrant and confirm the information provided by You in the Questionnaire is correct. Should any of the information change, You must notify EDF Energy.
- You must not charge Your electric vehicle using any socket outlet other than the home charge point provided and installed by EDF Energy on the Premises. If You use any other socket either on or off of the Premises, EDF Energy shall have no liability in respect of any loss or damage caused by such charging to You, any third or related party, Your vehicle or any other form of Your or another persons property.
- EDF Energy may install parts of the Equipment in several locations in the Premises which may need to be connected with cabling, conduit or trunking. You agree to allow EDF Energy to carry out this work which may involve drilling, wiring and/or temporary removal of floorboards (the “Work”).
- EDF Energy shall not be liable, to the extent permitted by law for any loss that You may suffer as a result of Your failure to notify any organisation or individual of the Work if You are required to do so.
- EDF Energy will need access to Your premises to survey and install the Equipment and discuss the installation and the nature and operation of the Equipment with You. So EDF Energy can do this, You will need to be present throughout the installation. You acknowledge that the Work may take 1 day or longer, and that EDF Energy may require You to be present during this time.
- You agree to provide EDF Energy with access to the Premises to repair the Equipment at a mutually convenient time between 9am and 5pm on a Working Day and at any time where EDF Energy deem there to be an emergency situation.
- You will be liable for all costs, damages, expenses and losses incurred by You or a third party where You:
- tamper or damage the Equipment;
- use the Equipment for anything other than its intended use and as specified in the User Manual;
- refuse to allow EDF Energy access to maintain or correct any defects in the Equipment; or
- connect the electric vehicle to anything other than the Equipment.
- The Equipment supplied by EDF Energy may not be compliant with all electric vehicles. For advice on charging different electric vehicles at the Premises, please contact EDF Energy on 0800 096 9636* or the supplier of Your vehicle.
- The Equipment is vehicle specific and has been provided to You for use with the vehicle You confirmed in the Questionnaire. You must notify EDF Energy as soon as reasonably possible should change Your vehicle to enable EDF Energy to assess whether the Equipment is still appropriate.
- Nothing in this Agreement excludes liability for death or personal injury caused by negligence or for any liability to You arising from a breach by EDF Energy of its statutory duty under Part 1 of the Consumer Protection Act 1987.
- You may not assign or otherwise transfer Your rights or obligations under this Agreement.
- Payment Terms
- You agree to pay a non refundable site booking fee of £50 prior to any site visit by EDF Energy.
- EDF Energy will determine if the installation of the Equipment at Your Premises shall be a standard or non standard installation.
- Where an installation is deemed non standard, the cost will be determined by EDF Energy on receipt of Your site survey. You agree to pay 25% deposit before work commences.
- Following installation You will pay the remaining balance of:
- £749, in the case of a standard installation
- In the case of a non-standard installation, the remaining 75% of cost due stated on you initial estimate (minus the initial £50 deposit).
- Both sums for the standard or non standard EcoRecharge Package installation, to be paid within 10 Working Days.
- If You do not pay the remaining balance EDF Energy reserves the right to remove the Equipment from the property and You will not benefit from any part of the Eco:Recharge Package.
- Because some of the Equipment may be linked into the EDF Energy billing systems, You agree that the billing date for electricity supplied to Your Premises may need to be changed.
- Warranty Terms
o acknowledge and agree that should You choose to be supplied with electricity by anyone other than EDF Energy at any time after installation, the use of the Electric Vehicle smart meter and Electric Vehicle statement in the EcoRecharge Package and will no longer be available.
- EDF Energy warrants to You, for a period of 3 (three) years from the date the Equipment is installed (the “Warranty Period”) that the Equipment shall function in accordance with its specification as set out in the User Manual and free from any defects.
- Subject to this Agreement if You give notice in writing to EDF Energy within a reasonable time of discovery that some or all of the Equipment does not comply with the Warranty and
- You give EDF Energy reasonable opportunity and access to examine the Equipment; and
- if asked to do so, You return the Equipment to EDF Energy, EDF Energy shall, at its option, repair or replace the defective Equipment or refund the price of the defective Equipment in full.
- EDF Energy shall not be liable for the Equipments failure to comply with the Warranty if:
- You make any further use of the Equipment after giving notice to EDF Energy;
- the defect arises because You failed to follow EDF Energy's oral or written instructions as to the storage, commissioning, installation, use and maintenance of the Equipment; or
- You alter or repair the Equipment without the written consent of EDF Energy.
- This Agreement applies to any repaired or replacement Equipment notwithstanding that the Warranty Period will still run from the date the initial Equipment was installed and any repair or replacement will not extend or vary the Warranty or Warranty Period.
- Joint Terms
- This Agreement and all matters, claims and disputes (whether contractual or non-contractual) are subject to the law of England and Wales, and You and EDF Energy submit to the exclusive jurisdiction of the Courts of England and Wales.
- EDF Energy shall not be obliged to provide You with the Eco:Recharge Package where Your Premises has a power supply of 60A or less unless You have signed a waiver in respect of any right of claim against EDF Energy in respect of any loss resulting from or connected with the level of Your power supply (a “Low Power Supply Waiver”).
- This Agreement together with the terms and conditions governing Your energy supply tariff, and a Low Power Supply Waiver (if applicable) constitute the entire agreement between You and EDF Energy concerning the Eco:Recharge Package. In the event of any inconsistency between any of the provisions of this Agreement and Your energy supply tariff this Agreement will prevail.
- Each of these terms is a separate provision and shall apply and survive if, for any reason, any other of these provisions is held to be invalid or unenforceable.
* Calls may be recorded for training and quality purposes. Calls to 0800 numbers are free from BT landlines but other network operators’ may charge for these calls.
"EDF Energy" is the trading name of EDF Energy Customers plc a company incorporated in England and Wales (registered no. 02228297) whose registered office is at 40 Grosvenor Place, Victoria, London SW1X 7EN.
All references to:
- EDF Energy shall be deemed to include (where applicable) any sub-contractors of EDF Energy, a list of which is available on request; and
- Working Day shall mean a day other than a Saturday, Sunday or a day where banks are closed for business in London.
